At ContentGuard, we’re committed to building products and services that are backed by over 20 years of innovation around protecting content.  Our technology has protected Hollywood movies, the music industry, and leading software companies from unwanted piracy. We are now focusing our efforts on protecting content that we all create.

We strive to apply our patented technology to products and solutions that we want our own families, friends, and colleagues to use in their daily lives and are committed to developing solutions that are simple, private and secure to use. With that in mind we honor the following privacy principles:

Addendum A:  ContentGuard Privacy Policy

We are in the business of protecting content you create whether it is a screenshot, a photo, an office doc or PDF file.  We want to make sure that your GUARDED content can be reliably shared and consumed by whomever you designate based on whatever CONTENTGUARD setting you choose.

We care a lot about your privacy.  This document is our Privacy Policy, which describes what information we collect from you and how we use it.

Our Privacy Policy applies to our website at contentguard.com, our mobile applications for iOS and Android and other apps and services we provide.  It covers Personally Identifiable Information (“PII”), which is information we can link to you personally.  PII includes data like your name, email address, cell phone number or your mobile device unique identifier.

1. We Only Collect Your Personal Information as Needed To Provide Our Services

ContentGuard collects only information that is needed to perform and improve our services to you, which we  store and associate with your account.  Privacy is a very serious matter to us and we will only use and disclose this information about you as described in this Privacy Policy.

2. Information ContentGuard Collects

A. REGISTRATION

In order to create an account with ContentGuard, you must create a unique username and select a password. Your mobile number is automatically made part of your ContentGuard profile, and is used by ContentGuard to verify your identity.  We similarly use your recipient’s mobile number to verify the recipient’s identity, as it’s important to us that your message be directed to correct intended recipient.

B. CREDIT CARD

If and when advanced features become available, we may collect your credit card number, expiration date, and security code. We will use this information solely to bill you for services.

C. MOBILE DEVICE

When you use ContentGuard Services, our servers automatically record certain information about your mobile device. This information may include information such as an equipment identifier (e.g., IMEI, UDID), subscriber identifier (e.g., IMSI), device name, mobile phone number, device type and manufacturer, operating system type and version, wireless carrier / operator, network type, country of origin, Internet Protocol (“IP”) address, and the dates and times of your requests. We use this information to provide our services.

D. SOCIAL MEDIA

Social media features (“Features”), like the Facebook recommend button or interactive mini-programs that run on our site, will collect your IP address, which page you are visiting on our site, and set a cookie to enable the Feature to function properly. Features may be hosted by a third-party or hosted directly on our site. Your interactions with these Features are governed by the privacy policy of the provider of the Feature, not by ContentGuard’s Privacy Policy.

E. INFORMATION ABOUT YOUR USE OF CONTENTGUARD SERVICES

We improve our products by using mobile analytics software.  This software records information about events that occur within the application, how often you use the application, and when the application was downloaded.  This information is not linked to any of your PII.

F. INFORMATION ABOUT YOUR USE OF CONTENTGUARD’S WEBSITE AND MOBILE WEBSITE

We use one or more analytics services to measure how people use our website so that we can improve our products and services. This information is not linked to any of your PII.

3. Cookie Policy

Like many online services, we use cookies and other tools to collect and analyze information about you and your usage of our services. Cookies are small data files that we transfer to your mobile device. We use “session” cookies to keep you logged in while you use our services, to better understand how you interact with our services, and to monitor aggregate usage and web traffic information on our services. Session cookies disappear when you log out and close your browser. We also use “persistent” cookies to recognize you when you return to our services. Persistent cookies can stay on your mobile device for a longer period of time than session cookies.

4. We Use Your Personally Identifiable Information to Provide and Improve Our Services

Your information is used internally on a limited basis to enhance and improve our services to you. For example:

  •  ContentGuard may use client device information to notify you of an operating system update.
  • If you fill out a survey or email ContentGuard for support, we will retain the information you give us in order to provide you with support and to improve our services.
  • We may share encrypted (hashed) equipment identifier numbers with analytics services to understand how new users find out about our application.
  • We may use your mobile number for administrative purposes, to notify you of privacy or security related notices, let you know about changes to our services, to send you product announcements, and perhaps other customer service related purposes.

5. Your Privacy is Not for Sale

ContentGuard will not sell any personally identifiable information we collect from you. Period.

6. If We Are Required by Law to Disclose Your Personally Identifiable Information We Will Notify You

If necessary to comply with a law, regulation, or legal request to insure the protection and the safety of any person; to address fraud, security, or technical issues; or to protect ContentGuard’s rights or property, we may be required to disclose your PII.  We will notify you electronically at the mobile number listed in your account before we disclose your PII, unless we are legally prohibited from doing so.

7. We Share Your PII When Necessary to Provide Our Services

We only use your PII to perform or improve our services. This may include sharing aspects of your PII with third-parties (for example, to map your location or send you an SMS).  We require that these parties agree to process such information in compliance with our Privacy Policy, that they use reasonable efforts to limit their use of such information, and that they use appropriate confidentiality and security measures to protect your information.

8. We May Use Your PII to Avoid Unnecessary Marketing

Your status as a current ContentGuard customer may be shared with partners and service providers to avoid receiving duplicate or unnecessary marketing about ContentGuard.  Our partners are contractually prevented from using this information for any other purpose.

9. We Take Security Seriously

ContentGuard is a privacy company, and securing your data is one of our top priorities. ContentGuard uses commercially reasonable physical, managerial, and technical safeguards. For example, we use a combination of firewalls, encryption, authentication, physical security, and other safeguards to protect your account and your data.

When you enter sensitive information (such as credit card number or location based information) on our website, within the ContentGuard app, or in our order forms, we encrypt that information using secure socket layer technology (SSL).

We perform third-party penetration tests to harden our systems from attack. We cannot, however, ensure or warrant the security of any information that you or your recipients transmit us us. All such transmission of information is at your own risk.

We cannot guarantee that information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If ContentGuard learns of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. ContentGuard may also post a notice on the ContentGuard site if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

10. You Are Responsible for Maintaining the Accuracy of Your PII

You are responsible for the secrecy of your password at all times. ContentGuard recommends a strong password that you do not use with other services. If you believe your password has been compromised, please change your password immediately via the ContentGuard app, or contact us at support@ContentGuard.com for assistance.

11. International Visitors and Safe Harbor Compliance

ContentGuard is a Plano, Texas-based company with servers housed in the United States. Personal information collected from users outside the United States is transferred to the United States and processed according to United States law.

ContentGuard complies with the U.S. – E.U. Safe Harbor Framework and the U.S. – Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. ContentGuard has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. 12. You Need a Parent’s Permission to Use ContentGuard if You Are Under the Age of 13

Our services are not directed to children under 13 and we do not knowingly collect PII from children under 13.  If you believe a child is using this service without parental consent, please contact us at privacy@ContentGuard.com.

13. We Are Not Responsible for Content on Third-Party Websites

Our site contains links to other websites. When you click on one of these links, you leave ContentGuard’s website and go elsewhere. ContentGuard does not accept liability for misuse of any information by any website controller to which we may link. We encourage you to read the privacy statements of these linked sites, which may differ from ours. In addition, if you take advantage of an offer from one of our partners, you may be providing information directly to that partner. We encourage you to review the privacy statements of these partners, as we are not responsible for the privacy practices of any partners or linked sites.

14. We Post Updates on Our Website Whenever This Policy Changes

This Privacy Policy may be revised. If we make material changes to this policy, then we will notify you in our application, here on this website, by email, or by means of a notice on the ContentGuard Services home page.
